These Terms of Use (“Terms”) govern your access to and use of www.fesariustherapeutics.com (the “Site”), operated by Fesarius Therapeutics, Inc. (“Fesarius,” “we,” “us”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. Intended audience

The Site is intended for residents of the United States. Product information on the Site is intended for U.S. healthcare professionals. Products may not be available in all markets, and product claims and indications may differ outside the United States.

2. Informational purposes only; no medical advice

Content on the Site is provided for general informational and educational purposes. It is not medical advice and is not a substitute for the professional judgment of a qualified healthcare provider. Clinicians should consult the DermiSphere™ hDRT Instructions for Use for indications, contraindications, warnings, precautions and instructions before use. Patients should talk to their healthcare provider about their treatment options.

Preclinical results described on the Site do not necessarily translate to clinical outcomes.

3. Intellectual property

The Site and its content, including text, graphics, images, video, logos and the selection and arrangement of content, are owned by or licensed to Fesarius and are protected by copyright, trademark and other laws. DermiSphere™ is a trademark of Fesarius Therapeutics, Inc. Other names and marks belong to their respective owners.

You may view and print content for your personal, non-commercial or professional reference, provided you keep all copyright and other notices. You may not otherwise copy, modify, distribute, republish, frame or create derivative works from the Site without our prior written permission.

4. Acceptable use

You agree not to:

  • use the Site in violation of any law or regulation;
  • submit patient-identifiable or protected health information through the Site;
  • attempt to gain unauthorized access to the Site, its servers or related systems, or interfere with its operation or security;
  • use automated means (such as bots or scrapers) to access or collect content from the Site, except as permitted by our robots.txt file;
  • submit content that is false, misleading, defamatory, infringing or otherwise unlawful.

5. Information you submit

Information you submit through the Site is handled as described in our Privacy Policy. Do not send confidential or proprietary information (for example, unsolicited product ideas) through the Site. If you do, you agree that Fesarius has no obligation of confidentiality with respect to it.

6. Adverse events and product complaints

The Site and contact form are not monitored for adverse-event reporting. To report an adverse event or product complaint, contact Fesarius Customer Service at customerservice@fesariustherapeutics.com or 833.900.4378 and/or the FDA MedWatch program at www.fda.gov/medwatch.

7. Third-party links and content

The Site may contain links to third-party websites and resources, including published articles. These links are provided for convenience only. We do not control and are not responsible for third-party content, products or practices, and a link does not imply endorsement.

8. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that content is complete or current.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FESARIUS AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE.

10. Indemnification

You agree to indemnify and hold harmless Fesarius from any claims, losses and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.

11. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in New York, New York, and you consent to their jurisdiction.

12. Changes

We may change these Terms or the Site at any time. Changes take effect when posted with an updated “Last updated” date. Your continued use of the Site after changes are posted means you accept them.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and Fesarius regarding the Site.
